This Privacy Policy describes how The Manginello Law Firm, PLLC (branded as “Attorney 911” or “ATTY 911,” and referred to here as “we,” “us,” or “our”) collects, uses, and protects information in connection with the ATTY 911 mobile application (the “App”). By using the App, you agree to the practices described in this Policy.
1. Who We Are
ATTY 911 is a personal-injury legal-information and case-preparation app published by The Manginello Law Firm, PLLC, a Texas law firm. The App helps people involved in an accident document their situation, understand their case, and connect with legal help. Questions about this Policy can be directed to Ralph@Atty911.com.
2. Information We Handle
The App is designed so that your case information stays on your device until you choose to submit it. The types of information the App can handle include:
- Contact information: your name, phone number, and email address. This is captured once and used to reach you in connection with your case and for lead intake.
- Case information: accident details, your narrative, progress milestones (e.g., calling 911, documenting the scene), and notes you enter.
- Evidence: photographs you capture or select, plus witness and injury information you record.
- Voice input: audio captured by your microphone for speech-to-text dictation and transcription, processed by your phone's built-in speech recognition.
- Analysis results: summaries and guidance generated by the App's AI analysis feature.
3. How We Use Information
- To operate the App's features on your device (case documentation, dictation, evidence organization, and AI-assisted analysis).
- To provide AI analysis when you enable it, by sending the information you provide to our third-party AI provider (see Section 5) so it can generate the results you request.
- To contact you about your case and to process a lead or submission when you choose to send one to us.
- To improve the App's features and reliability.
We do not sell your information, and we do not use it for targeted advertising.
4. Where Your Data Is Stored
Your case data remains on your mobile device in the App's local storage until you choose to submit it. We do not maintain a server-side database of your case data at this time. You can remove your data at any time by using the App's clear/start-over function or by uninstalling the App.
5. When Information Leaves Your Device
Information leaves your device only in these situations:
- AI analysis (third-party AI service). When you choose to use an AI feature, the relevant case text, live Guard Dog conversation transcripts, the context you enter (such as insurance carrier, injury type, and damage description), and any photographs you select — including ID-card photos you scan in MY INFO — are transmitted over a secure (HTTPS) connection to our third-party AI provider, Ollama (ollama.com), which runs the Gemini AI language model to process them and return the analysis to your device. The App asks for your explicit permission before any information is shared with this service, and you can withdraw that permission at any time within the App (FIRM tab → Privacy & Your Data). Per its privacy policy, Ollama does not use your inputs to train AI models and does not retain content beyond fulfilling the request. We do not sell this data, and the provider processes it only to generate the analysis you request.
- AI voice (ElevenLabs). When ATTY speaks a reply aloud, the text of that reply — which can reference your case details — is sent over a secure (HTTPS) connection to ElevenLabs (elevenlabs.io), a third-party AI voice service, to generate the audio you hear. This happens only after you have agreed to AI data sharing in the App. We send only reply text — never your photos, documents, contact details, or recordings. You can mute ATTY's voice at any time with the speaker button, and withdrawing AI sharing stops it entirely. ElevenLabs processes this text under its own privacy policy.
- Submitting your case to us & follow-up. When you save your contact information in the App and agree that we may contact you, the App may send our firm your contact details and periodic case-progress updates (including the AI-generated case summary) over a secure (HTTPS) connection to attorney911.com through our case-intake system so we can follow up with you. Unchecking the contact box or removing MY INFO stops these updates, and you can request deletion of anything already sent by contacting us. When you choose to submit your case, your full case information is transmitted the same way.
- Phone and website links. Tapping the call button or a website/social link opens your phone's dialer or browser; that action is initiated by you and is not data transmission by the App.
Speech-to-text stays on your phone. Dictation and Guard Dog transcription use your phone's built-in speech recognition (Apple on iPhone; Google or your device maker on Android). We request on-device processing wherever the device supports it, and your audio is never sent to our servers or to our AI providers — only the resulting text is shared, and only with your AI permission.
6. Permissions the App Uses
- Microphone — for voice dictation and transcription (your phone's built-in speech recognition).
- Camera and Photos — to capture and select evidence photographs.
- Storage — to save your case and evidence on your device.
- Internet access — for AI analysis, case submission, and website links.
You can grant or revoke these permissions in your device settings at any time; revoking a permission disables the related feature.
7. Third-Party Services
- Ollama (ollama.com) — a third-party AI service running the Gemini AI language model. When you enable an AI feature, the App sends it the case text, context, conversation transcripts, and photographs you choose to analyze; it processes them and returns the results to your device. It is used only to generate your requested analysis, and only after you have given permission in the App. Per its privacy policy, it does not use your inputs to train AI models and does not retain content beyond fulfilling the request.
- ElevenLabs (elevenlabs.io) — a third-party AI voice service. After you have agreed to AI data sharing, when ATTY speaks a reply aloud the App sends ElevenLabs the text of that reply to generate the audio; nothing else is ever sent to it.
- Our WordPress case-intake system (attorney911.com) — receives your contact details, case-progress updates after you agree to be contacted, and your case when you submit it to us.
- Your phone's built-in speech recognition — transcribes your voice; we request on-device processing wherever the device supports it.
We require any third party that processes information on our behalf, including our AI provider, to protect it with safeguards at least equal to those described in this Policy and to use it only to provide the requested service.
The App does not include advertising networks, cross-app trackers, or analytics SDKs that profile you across other apps or websites.
8. Attorney Advertising; No Attorney-Client Relationship
The App is attorney advertising. It provides legal information and educational analysis, not legal advice. Using the App, creating a case, or submitting information to us does not create an attorney-client relationship between you and The Manginello Law Firm, PLLC, and no attorney of record is engaged unless and until you and the firm execute a written representation agreement. You are free to choose any law firm to represent you; our firm is one option, not a requirement. Prior results do not guarantee a similar outcome.
9. Data Retention
Currently, your case data is retained on your device until you delete it or uninstall the App. We do not retain your submitted case data in a server-side database at this time. When the optional secure online vault becomes available, retention for data you choose to store there will be described in an updated Policy.
10. Children
The App is intended for adults and is not directed to anyone under 18. We do not knowingly collect information from children. If you believe a minor has provided information, contact us and we will take appropriate steps.
11. Your Rights and Choices
You can access, correct, or delete the information stored in the App at any time through the App's controls or by uninstalling it. For any information you have submitted to us, you may request access to, correction of, or deletion of that information by contacting Ralph@Atty911.com. To the extent required by applicable law (including applicable U.S. state privacy laws), we will respond to verified requests within a reasonable timeframe.
12. Security
We use reasonable technical and organizational measures to protect your information. Data transmitted for AI analysis and case submission is sent over HTTPS. Because your case data is stored primarily on your own device, the security of that data also depends on your device's security (lock screen, OS updates, etc.). No method of transmission or storage is completely secure, but we work to protect your information.
13. Changes to This Policy
We may update this Privacy Policy from time to time. Changes will be posted to this page with an updated effective date. Material changes will be reflected here; we encourage you to review this Policy periodically.
