GATESVILLE MOTOR VEHICLE ACCIDENT LAWYER | Attorney911 Legal Emergency Lawyers™

If you’ve been hurt in a car accident in Gatesville, we understand exactly what you’re going through right now. One moment you’re driving down State Highway 36, heading toward Fort Hood or running errands near the downtown square. The next moment, everything changes. The screech of tires. The impact. The confusion and pain. The ambulance ride to Coryell Health or the long journey to a trauma center in Waco or Temple. The medical bills piling up while you’re too injured to work. The insurance adjuster calling before you’ve even left the emergency room, sounding helpful but asking questions designed to hurt your claim.

You’re scared. You’re overwhelmed. You’re wondering how you’ll pay for everything and what happens next. We’re here to tell you: you don’t have to face this alone. At Attorney911, we’ve spent 27+ years fighting for injured Texans just like you, and we know how to get results.

In 2024 alone, Texas saw 4,150 people killed in motor vehicle crashes — that’s one death every 2 hours and 7 minutes. Coryell County, where Gatesville sits as the county seat, experiences its share of these tragedies, with crashes on our rural highways, intersections near the military base, and the busy corridors connecting us to Killeen, Waco, and beyond. When we look at the data, one thing is clear: these aren’t just statistics. They’re real people whose lives have been shattered by someone else’s negligence.

THE REALITY OF CAR ACCIDENTS IN GATESVILLE & CENTRAL TEXAS

Most people think a car accident is something that happens to someone else. But here in Gatesville, we’re connected by highways that carry heavy military traffic from Fort Hood, commercial trucks moving goods across Central Texas, and daily commuters heading to bigger job centers. Every time you merge onto US 84 or navigate the intersection of SH 36 and SH 84 near the courthouse square, you’re trusting that other drivers will follow the rules. Unfortunately, they don’t always do that.

In Texas, the numbers are staggering. Driver inattention caused 81,101 crashes statewide in 2024. Failed to control speed caused 131,978 crashes — that’s 513 fatal collisions from people who simply couldn’t slow down in time. And here in Coryell County, where our roads mix high-speed rural travel with sudden stops in town, these factors are especially dangerous.

The Texas Department of Transportation tells us that single-vehicle run-off-road crashes killed 1,353 people statewide last year, making it the #1 fatal crash type in Texas. On our two-lane farm-to-market roads outside Gatesville — places like FM 932 or FM 1672 — a moment’s inattention can send a vehicle into a ditch or head-on into oncoming traffic. These rural crashes are 2.66 times more likely to be fatal than accidents in urban areas, partly because of higher speeds and longer emergency response times. When you’re 30 miles from the nearest Level I trauma center, every minute matters.

WHY INSURANCE COMPANIES ARE NOT YOUR FRIENDS

Within days — sometimes hours — of your accident, you’ll hear from an insurance adjuster. They’ll sound sympathetic. They’ll say they just want to help you get a quick settlement so you can move on. They might even offer you a check right away. Here’s what they won’t tell you: that adjuster has one job, and it’s not to help you. It’s to pay you as little as possible.

We’ve seen insurance companies use the same tactics over and over. They’ll ask for a recorded statement, hoping you’ll say something they can twist to blame you for the crash. They’ll send you to an “independent” medical exam with a doctor they’ve paid thousands of dollars to minimize your injuries. They’ll comb through your social media, looking for any photo or post they can take out of context to claim you’re not really hurt.

But here’s what makes Attorney911 different: Lupe Peña, one of our lead attorneys, worked for years as an insurance defense attorney at a national defense firm. He learned firsthand how these companies operate. He knows how they use software like Colossus to undervalue claims. He knows which doctors they favor for IMEs because he hired them himself. He understands settlement authority structures, reserve psychology, and delay tactics from the inside.

Now he uses that insider knowledge to fight FOR you. When an insurance company tries to pull these tricks, we see them coming. We know how to counter them. And we won’t let them bully you into accepting less than you deserve.

THE ATTORNEY911 ADVANTAGE: EXPERIENCE THAT MATTERS

When you’re choosing a lawyer to handle something as important as your car accident case, you need more than promises. You need proof. At Attorney911, we have that proof.

Ralph Manginello, our managing partner, has been practicing law in Texas for over 27 years. He’s admitted to federal court in the Southern District of Texas — a credential that matters when your case involves complex federal regulations, like trucking accidents governed by FMCSA rules. Ralph’s background includes being involved in the BP Texas City Refinery explosion litigation, a massive case that killed 15 workers and injured over 180 others, ultimately settling for $2.1 billion. When we say we can take on big corporations and their insurance companies, we’re not bluffing. We’ve done it.

In a recent case, our client suffered a brain injury with vision loss when a log dropped on him at a logging company. That case settled in the multi-millions. We’ve helped numerous families facing trucking-related wrongful death recover millions. We secured a multi-million dollar settlement for a client whose leg injury from a car accident led to staff infections and partial amputation. In another maritime case, our client injured his back lifting cargo, and our investigation revealed he should have had assistance, leading to a significant cash settlement.

These aren’t just numbers. They’re real outcomes for real people. And we achieve them because we prepare every case as if it’s going to trial. Insurance companies know we’re not bluffing, and that often leads to better settlements without the stress of a courtroom battle.

But we also know that not every case starts with Attorney911. Greg Garcia came to us after another attorney dropped his case, saying they wouldn’t accept it. We took it on and got him the help he needed. Donald Wilcox was rejected by one company before we called him and helped him pick up a handsome check. When other lawyers say no, we often say yes — because we see the value that others miss.

TYPES OF MOTOR VEHICLE ACCIDENTS WE HANDLE

Rear-End Collisions in Gatesville

If you’ve been rear-ended on US 84 heading toward Waco or stopped at a light on SH 36 near the courthouse, you know how sudden and violent these crashes can be. The force throws your head and neck forward and back, often causing whiplash, herniated discs, or even traumatic brain injuries.

In Texas, rear-end collisions are among the least defensible accidents. The law presumes the trailing driver is at fault under Texas Transportation Code § 545.062. The only real defenses are rare: if you reversed suddenly, made an illegal lane change, or there’s a chain reaction. For the most part, liability is clear.

But here’s what many people don’t realize: the injuries are often delayed. You might walk away feeling sore but think you’re fine. Then days later, the neck pain becomes excruciating. You can’t turn your head. Your lower back radiates pain down your leg. That’s when you discover you’ve herniated a disc and need surgery.

We represented a client whose leg was injured in a rear-end collision. Staff infections during treatment led to a partial amputation. That case settled in the millions. We’ve also seen seemingly minor rear-ends escalate to surgeries costing over $100,000, with settlement values jumping from $15,000-$60,000 for soft tissue to $175,000-$500,000+ once surgery is involved.

Why choose Attorney911 for your rear-end case? Lupe understands how insurance companies evaluate these claims because he calculated them for years on the defense side. He knows when they’re lowballing you. We also know how to use the Stowers Doctrine — sending a demand within policy limits that, if unreasonably refused, makes the insurer liable for the ENTIRE verdict, even beyond their limits.

If you’re dealing with a rear-end collision in Gatesville, call us before you talk to any insurance adjuster. We’ll protect your rights and make sure you don’t get pressured into a quick, unfair settlement.

T-Bone and Intersection Crashes

Gatesville’s intersections can be dangerous, especially during peak hours or when military traffic from Fort Hood merges with local drivers. A driver running a red light on SH 36 or failing to yield at the SH 84 intersection can change your life in an instant.

Texas saw 31,693 crashes from drivers failing to yield at stop signs and another 20,963 from disregarding stop-and-go signals. These intersection crashes killed 1,050 people in 2024 alone. Side-impact collisions are particularly devastating because there’s so little protection between you and the other vehicle. When a larger truck or SUV T-bones a smaller car, the fatality risk skyrockets.

The good news is that intersection crashes often have clear liability. Red light cameras, witness statements, and police citations create powerful evidence. The bad news is that insurance companies will still try to minimize your injuries or argue comparative negligence.

We know how to counter these arguments. We’ve taken on cases where liability seemed clear to everyone except the insurance company, and we’ve forced them to pay what the case is worth. Our investigation team moves fast to preserve traffic camera footage (which is deleted in 7-30 days) and interview witnesses while memories are fresh.

Single-Vehicle and Run-Off-Road Accidents

If you ran off the road on FM 932 or rolled over on a rural stretch of US 84, you might think you have no case. But that’s not always true. In Texas, single-vehicle run-off-road crashes killed 1,353 people in 2024 — the deadliest crash type in the state. But many of these are caused by factors beyond driver error.

Vehicle defects like tire blowouts, brake failures, or steering malfunctions can cause you to lose control. If that’s what happened, the manufacturer is strictly liable under Texas product liability law. We’ve seen cases where a defective tire tread separated at highway speed, sending the vehicle into a rollover.

Road defects are another cause. Missing guardrails, dangerous shoulder drop-offs, potholes, or inadequate signage can all contribute to a crash. In these cases, the government entity responsible for maintaining the road can be liable under the Texas Tort Claims Act. However, you only have six months to provide notice of your claim — miss that deadline and you’re barred forever.

Another driver may have forced you off the road — a phantom vehicle that didn’t stop. In that case, your own uninsured motorist coverage can provide compensation.

We represented a client who was forced off the road by a hit-and-run driver. We used his UM/UIM coverage to secure a substantial settlement. The key is preserving the evidence: the vehicle must be inspected before it’s repaired or destroyed.

Head-On Collisions

Head-on crashes are among the most catastrophic accidents we see, and they’re often caused by drunk or impaired drivers crossing the center line. In Texas, wrong-way crashes on one-way roads killed 82 people in 2024, while wrong-side crashes (not passing) killed 177. Combined with head-on collisions from other causes, 617 people died.

The force of impact is doubled when two vehicles traveling toward each other collide. Combine that with the fact that 97% of deaths in car-vs-truck crashes are the car occupants, and you have a recipe for devastation.

If a drunk driver caused your head-on crash, you have multiple paths to compensation. First, the driver’s insurance policy. Second, dram shop claims against any bar or restaurant that overserved them. Texas Alcoholic Beverage Code § 2.02 allows us to hold these establishments accountable when they serve someone who was “obviously intoxicated.” With Fort Hood nearby and a 2 AM bar closing time in Texas, many of these drivers were coming from establishments that should have known better.

Third, punitive damages. If the DUI is charged as a felony (Intoxication Assault or Intoxication Manslaughter), there is NO CAP on punitive damages in Texas. The jury can award whatever they deem appropriate to punish the conduct, and that judgment cannot be discharged in bankruptcy.

Sideswipe and Lane-Change Accidents

SH 36 and US 84 see heavy truck traffic, and when an 18-wheeler changes lanes without checking its blind spot, the results can be devastating. Texas recorded 50,287 crashes from unsafe lane changes in 2024.

These crashes are particularly dangerous because they often cause a secondary collision. A sideswipe at 70 mph can send your vehicle spinning into traffic, causing a rollover or head-on crash. The driver who made the initial lane change is liable for ALL the consequences under the legal principle of proximate cause.

Commercial trucks have special obligations under FMCSA regulations regarding mirrors, blind spot monitoring, and driver training. When trucking companies cut corners, we hold them accountable.

Pedestrian Accidents

768 pedestrians were killed in Texas in 2024. That’s 19% of all roadway deaths, even though pedestrians are involved in just 1% of crashes. A pedestrian crash is 28.8 times more likely to be fatal than a car-to-car collision. Here in Gatesville, where we have crosswalks near the courthouse and shopping areas, pedestrians are vulnerable, especially after dark.

What many victims don’t realize is that their own car insurance can cover them as pedestrians through uninsured/underinsured motorist coverage. If a hit-and-run driver strikes you while you’re walking, or if the at-fault driver only has the state minimum $30,000, your UM/UIM policy can bridge the gap. We’ve had clients recover hundreds of thousands from their own policies because we knew to look there.

The key is that UM/UIM coverage isn’t just for when you’re in your car. It follows you as a pedestrian, cyclist, or passenger in someone else’s vehicle. This is one of the most underutilized sources of recovery in Texas personal injury law, and insurance companies rarely volunteer this information.

Motorcycle Accidents

With Fort Hood nearby and the beautiful Central Texas roads winding through the Hill Country, many residents enjoy motorcycle riding. But it’s dangerous. Texas saw 585 motorcycle fatalities in 2024. The #1 cause of fatal motorcycle crashes? A car turning left in front of the bike. The driver claims they “didn’t see” the motorcycle, but that’s not a defense — it’s an admission of negligence.

Motorcycle accidents result in catastrophic injuries: traumatic brain injuries (even with a helmet), spinal cord damage, broken bones, and road rash that can lead to severe infections and permanent scarring. Because riders have no protective cage, the medical costs are enormous.

The challenge in motorcycle cases is combating jury bias. Insurance defense attorneys paint riders as reckless risk-takers. We counter that by humanizing our clients, presenting evidence of safe riding records, and focusing on the car driver’s failure to pay attention.

We also know the insurance realities. The typical at-fault driver carries only $30,000 in coverage, but a motorcycle accident can easily generate $200,000 to $7 million in damages. That’s why identifying all available insurance — including the rider’s own UM/UIM, corporate policies if a commercial vehicle was involved, and any dram shop coverage — is critical.

Commercial Truck and 18-Wheeler Accidents

Texas leads the nation in truck accidents. In 2024, we had 39,393 commercial vehicle crashes that killed 608 people. Coryell County sits on major transit routes, and if you’ve been hit by a semi on US 84 or SH 36, you know the devastation these 80,000-pound vehicles can cause.

The statistics are sobering: in car-vs-truck collisions, 97% of those killed are in the passenger vehicle. Car occupants are 36.5 times more likely to die. This isn’t just an accident; it’s a massive force disparity that leaves victims with catastrophic injuries or wrongful death.

Trucking cases are incredibly complex and require federal court experience. Ralph Manginello’s admission to the U.S. District Court, Southern District of Texas, means we can handle the FMCSA regulatory issues, corporate defendants, and multi-state aspects these cases involve.

The “Deep Pocket Chain” in trucking cases includes:

  • The truck driver
  • The motor carrier (trucking company) — liable through respondeat superior AND direct negligence for hiring, supervision, and maintenance
  • The freight broker who arranged the load
  • The cargo shipper who improperly loaded the trailer
  • The maintenance provider who failed inspections
  • The vehicle or parts manufacturer if defects contributed

Each of these entities has separate insurance policies that can stack. Commercial trucks must carry $750,000 minimum for interstate operations, and most major carriers have $1-5 million in coverage. With catastrophic injuries, we can easily exhaust a single policy and need to tap into others.

We also use the MCS-90 endorsement — a federal requirement that guarantees payment to injured third parties even if the insurance policy would otherwise exclude coverage. This is the ultimate collection safety net in trucking cases.

Our investigation goes deep: we subpoena driver logs, ELD data, drug test results, maintenance records, and the truck’s “black box” event data recorder. We look at the carrier’s CSA scores (safety ratings) and out-of-service rates. And we do it fast because ELD data is only preserved for 30-180 days.

We helped numerous families recover millions in trucking wrongful death cases. We know what it takes to win against billion-dollar corporations.

Rideshare Accidents (Uber/Lyft)

Rideshare is statistically invisible in TxDOT data because it’s grouped with regular passenger vehicles, but crashes are rising nationwide. Since Uber and Lyft launched, fatal crash rates increased about 3% annually — roughly 987 additional deaths per year across the U.S.

If you’re injured as an Uber/Lyft passenger, or hit by a rideshare driver in Gatesville, the insurance structure is complex. There are three periods:

  • Period 1: App is on, driver waiting for a request — $50,000 per person / $100,000 per accident
  • Period 2: Ride accepted, driver en route to pickup — $1,000,000 liability
  • Period 3: Passenger in vehicle — $1,000,000 liability + $1,000,000 UM/UIM

The problem? The driver is classified as an “independent contractor,” so Uber/Lyft try to avoid liability. But we pursue arguments that they’re a “de facto employer” based on their control: they set pricing, routes, acceptance rates, driver scorecards, and can deactivate drivers. The more control, the stronger the argument.

We’ve helped victims hit by rideshare drivers tap into the $1 million policies that most people (and insurance adjusters) don’t know exist.

Delivery Vehicle Accidents (Amazon, FedEx, UPS, Pizza Delivery)

With online shopping booming, delivery trucks are everywhere. In Texas, “backed without safety” caused 8,950 crashes — delivery vehicles back up dozens of times per route.

UPS had 72 fatal crashes in a recent 24-month period; FedEx had 37. Amazon’s Delivery Service Partners (DSPs) were linked to 60 serious crashes between 2015-2021, including 10 fatalities.

The key to Amazon cases is piercing the “independent contractor” shield. Amazon controls everything: delivery quotas, routing software, branded uniforms and vehicles, surveillance cameras inside vans (“Driveri” AI cameras), driver scorecards, and deactivation power. Despite calling DSPs independent contractors, Amazon’s control makes them potentially liable through negligent hiring and supervision.

We represented a client hit by a delivery truck backing out of a driveway. The driver was rushing to meet Amazon’s unrealistic delivery quotas. We secured a substantial settlement by proving Amazon’s business model created the hazard.

Drunk Driving and DUI Accidents

Texas is the DUI capital of large states. In 2024, 1,053 people were killed in DUI-alcohol crashes — that’s 25.37% of ALL traffic deaths. The peak time? 2:00-2:59 AM on Sunday mornings, right when Texas bars close under TABC regulations. Every single one of those 2 AM DUI crashes involves a bar that overserved the driver.

If a drunk driver hit you in Gatesville, you have powerful legal options. The driver’s insurance is just the start. Under the Texas Dram Shop Act (Alcoholic Beverage Code § 2.02), we can hold bars, restaurants, and liquor stores accountable if they served someone who was “obviously intoxicated.” Signs include slurred speech, bloodshot eyes, unsteady gait, fumbling with money, or aggressive behavior.

Dram shop defendants carry commercial insurance policies of $1 million or more. This is the deep pocket you need when facing catastrophic injuries.

If the DUI is charged as a felony (Intoxication Assault or Intoxication Manslaughter), there is NO CAP on punitive damages. The jury can award whatever they deem appropriate, and that award cannot be discharged in bankruptcy. This is the nuclear option against drunk drivers.

Ralph’s membership in the Harris County Criminal Lawyers Association means we handle both the criminal charges against the drunk driver AND your civil recovery. We’ve secured dismissals in multiple DWI cases through thorough investigation, and we bring that same rigor to your injury claim.

Distracted Driving Accidents

Even though Texas banned texting while driving, the fine is only $200 — the same as a parking ticket. The real penalty is paid by victims. Distracted driving killed 380 people in Texas in 2024, with cell phone use contributing to 3,121 crashes.

Driver inattention overall caused 81,101 crashes. That’s one every 6.5 minutes. When someone is texting, they travel the length of a football field at 55 mph without looking at the road.

We subpoena cell phone records to prove distraction. The timestamp on a text or social media post can be the smoking gun that proves liability.

Hit-and-Run Accidents

Every 43 seconds, someone in the U.S. is involved in a hit-and-run. In Texas, the penalties are severe: death = 2nd degree felony (2-20 years), serious injury = 3rd degree felony, minor injury = state jail felony.

But criminal charges don’t pay your medical bills. That’s where uninsured motorist coverage comes in. We help victims file UM claims against their own policies, which cover hit-and-run accidents. The key is acting fast — surveillance footage is deleted in 7-30 days. We send preservation letters immediately to secure evidence.

Tesla, Autopilot, and Self-Driving Car Accidents

Tesla’s Autopilot is involved in 70% of driver-assist crashes reported to NHTSA. In December 2023, Tesla recalled over 2 million vehicles. The technology is marketed as “Full Self-Driving,” but it’s really driver assistance — and that mischaracterization leads to overconfidence.

We’ve seen cases where drivers weren’t paying attention because they thought the car was driving itself. When it fails, the results are catastrophic. We pursue claims against Tesla for product liability, arguing they knew about defects and used over-the-air patches instead of recalls.

These cases require federal court experience, which Ralph brings. The $240 million jury verdict in Miami in August 2025 shows juries are holding Tesla accountable.

Construction Zone Accidents

Texas had nearly 28,000 work zone crashes in 2024, killing 215 people — a 12% increase. In Gatesville and surrounding areas, road work on SH 36 and other highways creates hazards. Contractors and government entities have a duty to provide adequate signage, barriers, and warnings. When they fail, we hold them accountable under the Texas Tort Claims Act or direct negligence.

Bus Accidents

Texas leads the nation in bus accidents with 1,110 crashes in 2024, 17 fatal. School buses alone were involved in 2,523 crashes in 2023, causing 11 deaths and 63 serious injuries. Bus accidents involve complex government liability issues with strict notice deadlines. We know how to navigate these requirements.

E-Scooter and E-Bike Accidents

Texas classifies e-bikes into three categories. Class 3 bikes (up to 28 mph) are treated similarly to bicycles but have higher injury risks. If an e-bike exceeds 750 watts or 28 mph, it may be classified as a motor vehicle, changing insurance and liability rules.

We’ve represented riders hit by cars who didn’t respect the e-bike’s right to the road. These cases require understanding both traffic laws and product classifications.

Bicycle Accidents

78 cyclists died in Texas in 2024. While that’s down 26%, any cycling accident is serious. Insurance companies love to blame cyclists, arguing they violated traffic laws or were riding unsafely. We fight back with accident reconstruction and witness testimony.

Boat and Maritime Accidents

Gatesville may be landlocked, but many Central Texans travel to nearby lakes like Belton Lake or Stillhouse Hollow Lake. We represented a client who injured his back lifting cargo on a ship. Our investigation revealed he should have been assisted, and we reached a significant cash settlement. Maritime cases fall under federal law (Jones Act, general maritime law), requiring federal court admission — which Ralph has.

Weather-Related and Other Accidents

Here’s a counterintuitive fact: 90.3% of Texas crashes happen in clear or cloudy weather. Rain causes only 8.4% of crashes. Weather is rarely the real cause — driver behavior is. We use weather data to prove the driver was negligent regardless of conditions.

For ambulance accidents, police pursuit crashes, and other specialized situations, we apply the same deep investigation and knowledge of specific liability doctrines.

UNDERSTANDING YOUR INJURIES & MEDICAL NEEDS

After a serious accident, your medical treatment is the foundation of your case. But it’s also critical for your recovery. We help clients understand their injuries and connect them with appropriate specialists.

Traumatic Brain Injury (TBI)

TBI symptoms can be delayed. You might have a headache and dizziness immediately, but days later develop memory problems, personality changes, or sleep disturbances. Even a “mild” concussion can have lasting effects. We work with neuropsychologists and neurologists to document these injuries because insurance companies claim you’re “fine” if you can walk and talk.

Spinal Cord Injury

From a herniated disc that needs surgery to complete paralysis, spinal injuries are life-changing. Treatment costs range from $50,000 for a single-level fusion to $6 million+ for lifetime care of high cervical quadriplegia. We work with life care planners to calculate future needs and ensure your settlement covers them.

Amputations

Whether traumatic (severed at scene) or surgical (due to infection or crush injury), amputations require lifelong prosthetic care. Basic prosthetics cost $5,000-$15,000 and need replacement every 3-5 years. Advanced computerized limbs run $50,000-$100,000. We secure multi-million dollar settlements to cover these costs, as we did for our client whose amputation resulted from a car accident infection.

Burns, Fractures, and Soft Tissue

Even “minor” injuries require proper documentation. Insurance companies undervalue soft tissue injuries, but 15-20% develop chronic pain. We ensure your treating physician uses specific diagnostic language that triggers higher valuation in insurance software.

THE 48-HOUR ACTION PROTOCOL: WHAT TO DO RIGHT NOW

If you’re reading this within hours or days of your accident, here’s exactly what you need to do to protect your claim:

HOUR 1-6:

  • Get to safety and call 911
  • Accept medical transport to Coryell Health or a trauma center if needed
  • Photograph everything: all vehicles, damage, scene, injuries
  • Exchange information but do not discuss fault
  • Get witness names and phone numbers
  • Call Attorney911 BEFORE talking to any insurance company: 1-888-ATTY-911

HOUR 6-24:

  • Preserve all evidence: damaged clothing, receipts
  • Email yourself copies of all photos and documentation
  • Request ER records before discharge
  • DO NOT give a recorded statement to the other driver’s insurance
  • Make all social media private and stop posting about the accident

HOUR 24-48:

  • Follow up with a doctor within 24-48 hours
  • Call Attorney911 for your free consultation
  • Bring all documentation
  • Let us handle all insurance communication

Critical Timeline Evidence:

  • Surveillance footage: Deleted in 7-30 days
  • ELD/truck black box data: Deleted in 30-180 days
  • Witness memories: Fade within weeks
  • Statute of limitations: 2 years, but government claims require notice in just 6 months

TEXAS LAW: YOUR RIGHTS AND PROTECTIONS

Modified Comparative Negligence (51% Bar)

Texas uses a “51% bar” rule. You can recover damages if you’re 50% or less at fault. But your recovery is reduced by your fault percentage. If you’re 25% at fault on a $250,000 case, you receive $187,500. If you’re 51% at fault, you get $0.

Insurance companies always try to assign maximum fault. Lupe made these fault arguments for years on the defense side. Now he knows how to defeat them.

Statute of Limitations

You have 2 years from the accident date to file a personal injury lawsuit. For wrongful death, it’s 2 years from the date of death. But for claims against government entities (road defects, city vehicles), you must provide notice within 6 months. Miss that deadline and your case is gone.

Punitive Damages

Standard cap: Greater of $200,000 or (2x economic damages) + (non-economic damages up to $750,000). BUT — if the conduct is a felony (DWI Intoxication Assault/Manslaughter), there is NO CAP.

Stowers Doctrine

If liability is clear and we send a settlement demand within the at-fault party’s policy limits, the insurer must accept or risk paying the entire verdict, even if it exceeds their limits. This is the nuclear option we use in rear-end and DUI cases.

Dram Shop Act

Bars and restaurants that overserve obviously intoxicated patrons can be held liable. We investigate where the driver was drinking and subpoena receipts, surveillance, and witness statements.

Texas Tort Claims Act

Sovereign immunity is waived for government negligence, but damages are capped at $250,000 per person / $500,000 per occurrence, and notice is due in 6 months.

UM/UIM Coverage

Your own policy covers you as a pedestrian, cyclist, or passenger. Texas insurers must offer it. Many people don’t know they have this coverage. We find it and maximize it.

CALCULATING YOUR COMPENSATION: WHAT YOUR CASE IS WORTH

Settlement Ranges by Injury

  • Soft tissue (whiplash): $15,000-$60,000
  • Simple fracture: $35,000-$95,000
  • Herniated disc requiring surgery: $346,000-$1,205,000
  • Traumatic brain injury (moderate-severe): $1,548,000-$9,838,000
  • Spinal cord injury/paralysis: $4,770,000-$25,880,000
  • Amputation: $1,945,000-$8,630,000
  • Wrongful death (working adult): $1,910,000-$9,520,000

Multiplier Method

Settlement = (Medical Expenses × Multiplier) + Lost Wages + Property Damage

  • Minor injuries: 1.5-2x
  • Moderate: 2-3x
  • Severe: 3-4x
  • Catastrophic: 4-5x+

Lupe knows how insurance companies apply these multipliers and which factors drive them higher. He calculated reserves using these formulas for years.

Factors That Maximize Value

  • Clear liability (red light camera, DUI conviction)
  • Surgery required
  • Permanent disability
  • High medical bills
  • Significant lost wages
  • Sympathetic plaintiff (young, children, elderly)
  • Egregious defendant conduct (DUI, extreme speed)
  • Strong evidence (video, witnesses)

Subrogation and Liens

Your health insurer, Medicare, Medicaid, or medical providers may have liens on your settlement. We negotiate these down to maximize your take-home recovery.

WHY CHOOSE ATTORNEY911 FOR YOUR GATESVILLE ACCIDENT CASE?

1. Former Insurance Defense Attorney on Your Side

Lupe Peña spent years at a national defense firm learning how insurance companies value claims, select IME doctors, and use delay tactics. Now he uses that insider knowledge FOR you. This is like having the other team’s playbook.

2. Federal Court Experience

Ralph Manginello is admitted to the U.S. District Court, Southern District of Texas. Complex trucking, maritime, and product liability cases often belong in federal court. Most personal injury lawyers avoid federal court. We’re comfortable there.

3. Multi-Million Dollar Track Record

Our case results speak for themselves:

  • Multi-million dollar brain injury settlement
  • Multi-million dollar amputation settlement
  • Millions recovered in trucking wrongful death cases
  • Significant maritime settlement
  • $10 million active hazing lawsuit against University of Houston

4. BP Explosion Litigation Experience

Our involvement in the BP Texas City Refinery explosion ($2.1B total case) proves we can take on Fortune 500 companies and win.

5. We Take Cases Other Lawyers Reject

Greg Garcia, Donald Wilcox, and others came to us after being turned away. We saw the value and got results. Some lawyers look for easy cases. We look for justice.

6. Spanish Language Services

Lupe Peña is fluent in Spanish, and our staff includes bilingual team members like Zulema. Hablamos Español. Gatesville’s Hispanic community deserves representation without language barriers.

7. Personal Attention

Our clients aren’t case numbers. As Stephanie Hernandez said: “When I felt I had no hope or direction, Leonor reached out to me…She took all the weight of my worries off my shoulders.” Dame Haskett told us: “Not one time did I call and not get a clear answer. Ralph reached out personally.”

8. 24/7 Live Staff

When you call 1-888-ATTY-911, you talk to a real person, not an answering service. Legal emergencies don’t wait for business hours.

9. Educational Resources

With over 290 educational videos on our YouTube channel and the Attorney 911 Podcast, we believe in giving you knowledge first. 10. Results in Months, Not Years

Chavodrian Miles told us: “Leonor got me into the doctor the same day…it only took 6 months amazing.” We move fast because evidence disappears and you need resolution.

FREQUENTLY ASKED QUESTIONS ABOUT GATESVILLE CAR ACCIDENTS

What should I do immediately after a car accident in Gatesville?

Get to safety, call 911, accept medical care, photograph everything, exchange information, get witness names, and call Attorney911 at 1-888-ATTY-911 before speaking to any insurance company. Preserve all evidence and make social media private.

Should I give a recorded statement to the insurance adjuster?

No. You are NOT required to give a recorded statement to the other driver’s insurance. They will use it against you. Once you hire Attorney911, all communication goes through us.

How much is my Gatesville car accident case worth?

It depends on injury severity, medical costs, lost wages, and liability clarity. Soft tissue cases: $15,000-$60,000. Surgery cases: $346,000-$1,205,000. Catastrophic injuries: millions. We evaluate for free.

What if the other driver was uninsured?

Texas has 14% uninsured drivers. Your own UM/UIM coverage can compensate you. It also covers you as a pedestrian. We find all available policies and stack them when possible.

Can I still recover if I was partially at fault?

Yes, under Texas’s 51% bar. If you’re 50% or less at fault, you recover reduced damages. At 51%+, you get nothing. Insurance companies always inflate your fault percentage. We fight back.

How long do I have to file a lawsuit?

2 years from the accident date for personal injury. 2 years from date of death for wrongful death. BUT — claims against government entities (road defects, city vehicles) require notice in just 6 months.

What if the drunk driver who hit me was coming from a Gatesville bar?

We investigate dram shop liability. Under Texas Alcoholic Beverage Code § 2.02, bars that overserve obviously intoxicated patrons are liable. Commercial policies are $1M+. We subpoena receipts, surveillance, and witness statements.

Do I need a lawyer if the insurance company already offered me money?

Yes. Early offers are 10-20% of true value. Once you accept and sign a release, you cannot get more money even if you need surgery later. Lupe knows their valuation methods from the inside. He knows when they’re lowballing.

What if I have a pre-existing condition?

The “eggshell plaintiff” rule says the defendant takes you as you are. If the accident worsened your condition, they pay for the worsening. This is common with degenerative disc disease. We work with doctors to prove the accident caused new damage.

How much do you charge?

We work on contingency: no fee unless we win. Standard is 33.33% if settled before trial, 40% if we go to trial. You pay nothing upfront. We advance all costs.

Will my case go to trial?

Most settle, but we prepare every case for trial. Insurance companies know our reputation and trial readiness, which often leads to better settlements. If they won’t be fair, we’re ready to fight in court.

Can I switch lawyers if I’m unhappy with my current one?

Yes. Greg Garcia did exactly that. His first attorney dropped his case, saying they wouldn’t accept it. We took it on and got results. We frequently take over cases from other firms. The transition is seamless.

How quickly can you get me into a doctor?

Leonor, our case manager, often gets clients in the same day. Chavodrian Miles said: “Leonor got me into the doctor the same day…it only took 6 months amazing.” We have relationships with specialists who work on liens, meaning you get treatment now and pay from settlement later.

What if I was hit by a government vehicle or in a construction zone?

We file Texas Tort Claims Act notices within 6 months. We sue contractors for inadequate signage or barriers. Government claims are capped at $250,000 per person, but we pursue all available coverage.

Can undocumented immigrants file injury claims in Texas?

Yes. Immigration status does not affect your right to compensation. Everyone is entitled to justice. We protect your status and fight for full recovery.

What if the crash was partly my fault?

You can still recover if you’re 50% or less at fault. Your damages are reduced by your fault percentage. We minimize the fault assigned to you through accident reconstruction and evidence.

How do you prove the other driver was texting?

We subpoena cell phone records, which show exact timestamps of texts, calls, and data usage. This is powerful evidence of negligence.

What if I didn’t feel hurt at first but pain developed later?

This is normal. Adrenaline masks injuries. Many serious injuries (TBI, herniated discs) have delayed symptoms. See a doctor immediately when pain develops. We connect the delayed symptoms to the accident through medical experts.

How long will my case take?

Soft tissue: 3-6 months. Surgery cases: 6-12 months. Complex cases (trucking, product liability): 12-24 months. We move as fast as possible while ensuring maximum value. Chavodrian Miles’s case settled in 6 months.

What if I need surgery but can’t afford it?

We connect you with lien doctors and surgeons who treat now and get paid from settlement. Don’t let cost delay necessary treatment — it hurts both your health and your case.

Can I sue if my family member died in a Gatesville car accident?

Yes. Wrongful death claims allow spouses, children, and parents to recover for loss of companionship, financial support, and mental anguish. We’ve recovered millions in trucking wrongful death cases.

What makes Attorney911 different from other Texas injury lawyers?

Lupe’s insurance defense background, Ralph’s 27+ years and federal court admission, our multi-million dollar results, BP explosion experience, and personal attention. We’re not a settlement mill — we prepare every case for trial.

How do I get started?

Call 1-888-ATTY-911 now. Free consultation. No obligation. We’ll review your case, explain your options, and give you a clear path forward. We serve Gatesville and all of Coryell County from our Texas offices.

THE INSURANCE COMPANY PLAYBOOK: WHAT THEY DON’T WANT YOU TO KNOW

Tactic 1: The Recorded Statement Trap

They call within days, sounding sympathetic, asking you to “just explain what happened.” Everything you say is recorded, transcribed, and WILL be used against you. You are NOT required to give this statement. Once you hire Attorney911, we handle all communication.

Tactic 2: The Quick Lowball Offer

Week 1-3, they offer $2,000-$5,000 while you’re desperate. Accept it and sign a release, and you’re done forever. Even if you need $100,000 surgery six months later, you cannot get another penny. These offers are 10-20% of true value. Lupe calculated these for years. He knows what your case is really worth.

Tactic 3: The “Independent” Medical Exam

They send you to a doctor they claim is independent. In reality, these doctors are paid $2,000-$5,000 by insurance for a 10-15 minute exam. They routinely find “pre-existing conditions” or claim you’re exaggerating. Lupe knows these specific doctors and their biases. We prepare you and challenge biased reports with our own experts.

Tactic 4: Delay and Financial Pressure

They ignore your calls for weeks, saying they’re “still investigating.” They have unlimited time and money. You have mounting bills, lost income, and creditors calling. By month 6, you’re desperate enough to accept their lowball. We file lawsuits to force deadlines. Lupe used delay tactics. He knows how to defeat them.

Tactic 5: Surveillance and Social Media Spying

They hire private investigators to video you. They monitor your Facebook, Instagram, TikTok, LinkedIn. One photo of you bending over to pick up your child becomes “proof” you’re not injured. LUPE’S INSIDER QUOTE: “I’ve reviewed hundreds of surveillance videos and social media posts as defense attorney. Here’s the truth: Insurance companies take innocent activity out of context. They freeze ONE frame of you moving ‘normally’ and ignore the 10 minutes of you struggling before and after.”

7 Rules to Protect Yourself:

  1. Make all profiles private
  2. Don’t post about the accident or injuries
  3. No check-ins at locations
  4. Tell friends not to tag you
  5. Don’t accept friend requests from strangers
  6. Best option: stay off social media entirely
  7. Assume EVERYTHING is monitored

Tactic 6: Blame-Shifting & Comparative Fault

They try to assign maximum fault to you. Even 10% fault on a $100,000 case costs you $10,000. Lupe made these arguments for years. Now he defends against them with evidence and expert testimony.

Tactic 7: The Medical Authorization Trap

They ask you to sign a broad authorization for your ENTIRE medical history. They’re not looking for treatment related to the accident — they’re hunting for pre-existing conditions from years ago to use against you. We limit authorizations to accident-related records only.

Tactic 8: Attacking Gaps in Treatment

You miss two weeks of physical therapy due to cost or scheduling. They claim: “If you were really hurt, you wouldn’t miss treatment.” We ensure consistent treatment by connecting you with lien doctors and documenting legitimate reasons for any gaps.

Tactic 9: Hiding Insurance Coverage

They say: “We only have $30,000 in coverage.” We investigate: personal auto, commercial policies, umbrella policies, corporate policies, UM/UIM stacking, MCS-90 endorsements. We’ve found $8+ million in coverage when they claimed $30,000. Lupe knows where to look.
