We’re Fighting This Battle Right Now β And We’ll Fight for Madison County Victims Too
Case: Bermudez v. Pi Kappa Phi Fraternity, Inc., et al.
Damages Sought: $10 MILLION
Filed: November 21, 2025 in Harris County Civil District Court
Attorneys: Ralph Manginello & Lupe Pena β Attorney 911
What Happened:
Leonel Bermudez, a “ghost rush” (not yet enrolled at University of Houston), accepted a bid to join Pi Kappa Phi in September 2025. Over the next seven weeks, he was subjected to systematic abuse including:
- Waterboarding with a garden hose (simulated drowning)
- Forced to perform 500+ squats and 100+ pushups until he collapsed
- Struck with wooden paddles
- Forced to eat milk, hot dogs, and peppercorns until vomiting
- Forced to continue running while in physical distress after vomiting
- Forced to lie in vomit-soaked grass
- Another pledge hog-tied face-down on a table with an object in his mouth for over an hour
- A pledge lost consciousness and collapsed during a workout
On November 3, 2025, Bermudez was punished for missing an event. He was forced to exercise until he could not stand without help. The next day, he was “really sore and couldn’t really move.” The day after that, his mother rushed him to the hospital where he was diagnosed with severe rhabdomyolysis and acute kidney failure, requiring four days of inpatient care.

βοΈ Your Legal Rights as a Madison County Hazing Victim
Texas Hazing Law: What Madison County Families Need to Know
Texas Education Code Β§ 37.151-37.157
Definition of Hazing in Texas:
Any intentional, knowing, or reckless act β on or off campus β that endangers the mental or physical health or safety of a student for the purpose of pledging, initiation, affiliation, holding office, or maintaining membership in an organization.
This includes:
- Physical brutality (hitting, paddling, waterboarding)
- Forced consumption of food, liquid, alcohol, or drugs
- Sleep deprivation
- Exposure to the elements
- Calisthenics or other activities that create unreasonable risk of harm
- Any activity that violates the Penal Code
Most Importantly:
“It is not a defense to prosecution that the person against whom the hazing was directed consented to or acquiesced in the hazing activity.”
This means: Even if your child “agreed” to participate, consent is not a defense. Hazing is illegal regardless of whether the victim consented.
Criminal Penalties for Hazing in Texas

|---|---|---|
| Class B Misdemeanor | Engaging in hazing | Up to 180 days jail, $2,000 fine |

π° Precedent Cases: Hazing Victims Can β and Do β Win Millions

1. Stone Foltz β Bowling Green State University / Pi Kappa Alpha (2021)
Total: $10.1 MILLION+
- Victim died from forced alcohol consumption
- Bowling Green State University paid $2.9 million
- Pi Kappa Alpha paid $7.2 million
- Our $10 million demand is directly in line with this precedent

Total: $6.1 MILLION JURY VERDICT
- Victim died from acute alcohol poisoning (BAC 0.495 β 6x legal limit)
- Jury awarded $6.1 million

Total: $110 MILLION+ (estimated)
- Victim consumed 18 drinks in 82 minutes, fell down stairs
- Fraternity members waited 12 hours to call 911

- Chapter permanently closed

- Future medical expenses (ongoing treatment, rehabilitation, potential surgeries)
- Lost wages (time missed from work during recovery)
- Future lost earning capacity (if injuries affect career)

Non-Economic Damages

- Emotional distress (humiliation, shame, depression)
- Loss of enjoyment of life (inability to participate in normal activities)

Punitive Damages
- Awarded when conduct is grossly negligent, reckless, or intentional
- Meant to punish the wrongdoer and deter future misconduct
- Texas has no cap on punitive damages in personal injury cases (only medical malpractice is capped)
