Entendiendo su choque: La física de la lesión
Un accidente automovilístico es un evento físico violento. Incluso un choque a “baja velocidad” implica transferencias masivas de energía.
Choques por detrás y la ventana de 300 milisegundos
Cuando está detenido en un semáforo en la FM 455 y un vehículo lo golpea por detrás, la lesión ocurre en cuatro fases distintas, todas ocurriendo en 300 milisegundos, más rápido de lo que puede parpadear.
- Fase 1 (0–50ms): Su vehículo es empujado hacia adelante. El respaldo de su asiento presiona su torso, pero su cabeza, sostenida solo por la columna flexible de su cuello, se queda en su lugar debido a la inercia.
- Fase 2 (50–100ms): Su cuello desarrolla una curva en S anormal ya que las vértebras inferiores se ven forzadas a la extensión mientras que las vértebras superiores todavía están en flexión. Aquí es donde ocurren la mayoría de las hernias de disco C5-C6.
- Fase 3 (100–175ms): Su cabeza alcanza la extensión máxima hacia atrás sobre el reposacabezas.
- Fase 4 (175–300ms): Su cuerpo rebota hacia adelante y su cuello se dobla en flexión extrema.
Usamos el sistema de clasificación WAD I-IV del Grupo de Trabajo de Quebec (QTF) para calificar estas lesiones. Si tiene un latigazo cervical “estándar”, la compañía de seguros le ofrecerá $1,500. Si probamos una lesión WAD III con déficits neurológicos (entumecimiento en los dedos, debilidad en el agarre), el valor del caso cambia a las cinco o seis cifras altas.
El marco legal: Cómo le protege la ley de Texas
Navegar por el Código de Prácticas y Remedios Civiles de Texas por su cuenta es como tratar de operarse a sí mismo. Pequeños errores pueden impedir su recuperación por completo.
Culpa comparativa modificada (§ 33.001)
Texas sigue una regla de “Barra del 51%”. Conforme al Tex. Civ. Prac. & Rem. Code § 33.001 (que establece la responsabilidad proporcional), usted puede recuperar daños siempre que tenga un 50% o menos de la culpa. Si un jurado determina que usted tiene el 51% de la responsabilidad, recibe cero. La compañía de seguros sabe esto e intentará “regalarle” un 10% o 20% de la culpa al inicio de las negociaciones para reducir su acuerdo. Luchamos para que el 100% de la responsabilidad recaiga en la parte negligente.
Pagado o Incurrido (§ 41.0105)
Uno de los aspectos más frustrantes de la ley de Texas es la regla Haygood v. de Escabedo, codificada en el Tex. Civ. Prac. & Rem. Code § 41.0105 (que limita la evidencia relacionada con el monto de los daños económicos). Este estatuto limita su recuperación de gastos médicos al monto “realmente pagado o incurrido”.
Si su factura del hospital en Medical City McKinney fue de $20,000, pero su seguro de salud negoció eso a $6,000, solo puede recuperar $6,000 del seguro del conductor culpable. Los otros $14,000 simplemente “desaparecen”. - Preserve la escena: Si es posible, tome fotos de su carro antes de que sea reparado. Tome fotos de sus moretones.
